摘要 当今社会，网络这种高速发展的传播途径给人类带来了极大的方便，已经成为日常生活中必不可少的部分。它迅速便捷，传输量大，自由化程度高，几乎有着其他一切传播媒介所没有的优点。作为一种新生事物，网络传播的出现也必然伴随着社会关系的改变，信息网络传播权就是在此情况下出现的。作为一种新的权利形式，信息网络传播权赋予了著作权人和邻接权人在网络上的一种新的财产权利，弥补了原有法律规定在专门调整网络著作权法律关系的空白。但是，信息网络传播权作为一种新权利，理论基础不够成熟，也缺乏实践检验，虽然解决了一些问题，发挥了重要的作用但是也有着不完善的地方。本文在论述信息网络传播权现状的同时，以我国信息网络传播权立法的为基本立足点，分析现行网络传播权现行立法的不足，提出改进建议，同时对信息网络传播权的国际保护提出对策，以期取得权利保护科特的专有性与权利利用范围的公开性之间的协调。 关键词 信息网络传播权；集成权利；合理使用 Abstract In this day, as a new transmission medium, Internet has been a necessary part in our everyday life, taking us tremendous benefit. It has almost each advantages that other mediums dose not have, like the high speed the large and the high freedom .As a newborn thing, The Right of Network Transmission appears under the situation that it will follow the change of the society relationship after the Internet transmission .As a new type of right, The Right of Network Transmission give a new type of property on the Internet to the author and the neighboring right person, which supplement the blank of regulations of the original law on the relationship adjusting the Internet literary property in law .But , The Right of Network Transmission also has shortages although it has solved some problems and play an important part in the normal day life ,because it dose not have the firm theory basis, lack of the examine in practice. This text, while describing information Network Communications right current situation, the ones that legislate are as the basic principle with the Network Communications right of information of our country, analyzed the deficiency of the current legislation of current Network Communications right, offer the suggestion of improving, protect countermeasure of proposing by world, Network Communications of right to information at the same time, it is make right protect department a special one getting exclusive to utilize coordination of openness of range with right in the hope of.
