医疗事故处理协议

鉴于甲方为医疗机构，乙方为患者（或患者家属），双方为了共同维护医疗秩序，保护患者权益，规范医疗行为，预防和处理医疗事故，依据《中华人民共和国合同法》、《中华人民共和国侵权责任法》、《医疗机构管理条例》等相关法律法规，经双方友好协商，特订立本医疗事故处理协议。
第一条Definitions
1.1MedicalAccident:AsdefinedinArticle7oftheRegulationsfortheImplementationoftheTortLiabilityLawofthePeoplesRepublicofChina,referstoinjuryordeathcausedtoapatientduetothefaultofamedicalinstitutionoritsmedicalstaffinthecourseofmedicaltreatment.
1.2parties:PartyAreferstothemedicalinstitution,andPartyBreferstothepatient(orthelegalrepresentativeofthepatient).
1.3EffectiveDate:ThedatewhenbothpartiessignthisAgreement.
1.4Term:ThisAgreementshallbeeffectiveforaperiodofoneyearfromtheEffectiveDate,andshallautomaticallyrenewforsubsequentoneyeartermsunlesseitherpartyprovideswrittennoticeofitsintentionnottorenewatleast30dayspriortotheexpirationoftheterm.
第二条ScopeofApplication
ThisAgreementappliestoallmedicalservicesprovidedPartyAtoPartyB,includingbutnotlimitedtodiagnosis,treatment,andhealthcareservices.
第三条ObligationsofPartyA
3.1QualityofMedicalServices:PartyAshallprovidehighqualitymedicalservicestoPartyBinaccordancewiththeapplicablestandardsandregulations.
3.3Confidentiality:PartyAshallkeepconfidentialallpersonalhealthinformationofPartyB,inaccordancewiththerelevantlawsandregulations.
3.4AccidentHandling:Intheeventofamedicalaccident,PartyAshallpromptlyandproperlyhandlethematterinaccordancewiththeprovisionsofthisAgreementandapplicablelawsandregulations.
第四条ObligationsofPartyB
4.2Cooperation:PartyBshallcooperatewithPartyAinthemedicaltreatmentprocess,followtheadviceofPartyA,andmakepaymentsforthemedicalservicesprovidedinatimelymanner.
4.3InformPartyA:IfPartyBhasanyspecialconditionsorrequirementsthatmayaffectthemedicaltreatment,
