PAGE PAGE 17 “失独家庭”的社会救助问题研究 ——社会救助的理论基础和法律对策探讨 摘要：19世纪70年代以来实行的计划生育政策在一定程度上解决了我国的人口问题和发展问题。然而近年来，该政策的负面作用日益凸显。计划生育政策的实施产生了我国所特有的以独生子女为主的家庭结构形态，而独生子女的丧生会使家庭结构严重失衡，失独群体将面临养老、医疗、心理等多方面的问题。妥善解决失独群体的养老问题，将有助于我国成功应对人口老龄化的挑战以及达成构建和谐社会的目标。本文首先着重对失独家庭获得社会救助的理论基础进行深入阐述，其次研究分析现行相关法律、制度的可行性和缺陷性，最后提出改进的对策意见，逐步加强社会救助的制度设计、不断完善社会救助的法律法规，为失独群体获得社会救助提供强有力的制度支持和法律支持。 关键词：失独家庭社会救助理论基础法律缺陷及对策 The study about social assistance problem of lost the only family -Research about theory foundation and law measure of social assistance Abstract: The planned parenthood policy that the 80s in 19th century practices worked out the population problem and development problem of our country to some extent.However in recent years, the negative function of the policy highlights day by day.The implementation of the planned parenthood produced an our country special regard only sons and daughters as principle of the home structure appearance, but the dying of only sons and daughters will make home the structure is only serious to be out of balance, lose ccommunity will face to retire to enjoy life, medical, mental state etc. various problem.Appropriate solution loses only a retiring to enjoy life of community problem, will contribute to our successfully should turn to the population advanced age of challenge and harmonious society of set up a target.This text emphasizes to carry on to the theory foundation that loses an exclusive court to acquire a social salvage first thorough elaborate, secondly study analytical current related law, system of possibility and blemish, finally put forward an improved counterplan opinion, gradually strengthen the law laws of the system design, continuously perfect social salvage of social salvage, for lose only community to acquire a social salvage to provide powerful system support and law support.
