哈尔滨商业大学硕士学位论文 摘 要 我国 《行政复议法》中所规定的行政复议制度在当今社会的运行过程中遭遇诸多困 境，根本原因是在制定该法时过度追求行政性与内部监督性，在逐步发展过程中失去了 平衡，最终导致复议机构缺乏自身独立性而失去了公信力。为了打破这一困境，2008年 原国务院法制办印发 《国务院法制办公室关于在部分省、直辖市开展行政复议委员会试 8 点工作的通知》，确定了在北京、黑龙江等 个省市开展行政复议委员会试点工作以进 行偏向司法化的改革。改革初期有少数代表性试点取得了一些成效，例如 “哈尔滨模 式”中的议决制度与吸纳外部委员的探索。但在后续实践中弊端逐渐显露，复议委员会 欠缺独立性、复议人员专业化程度不够、审理方式不科学等，导致行政复议并没有实质 性解决争议以达到为行政诉讼分流的目的，综合其原因是由于行政复议制度性质与功能 定位有偏差。应考虑保留复议委员会演进中的优点，并针对上述弊端，以提高独立性与 准司法性为出发点，来增强复议委员会的公正性与公信力，应通过修改 《行政复议法》 重新构建出一个以解决行政纠纷为主导功能且独立性强、办案人员高效专业、公正的行 政复议委员会，并增加 “调解”、 “回避”等制度以使其发挥作用。通过重构行政复议 委员会可以使行政复议制度解决行政争议来分流行政诉讼案件，使其真正的发挥作用。 关键词 行政复议；行政复议委员会；行政性；司法性 - -I 论我国行政复议委员会的重构 Abstract The administrative reconsideration system stipulated in Chinas Administrative Reconsideration Lawencounteredmany difficultiesin the operation process.Thebasic reason is the pursuit of administrative and internal supervision.
