浅议沉默权制度在我国实行的可行性 摘要 沉默权从观念上源于英国古老的谚语：“任何人无义务控告自己”，是被追 诉人即犯罪嫌疑人、被告人在被追诉过程中享有的对侦查人员、检察人员、审判 人员的询问保持沉默的权利。 本文以沉默权的起源及发展历史为出发点，肯定了沉默权的历史意义，对沉 默权的基木内容进行了分析。通过对沉默权与刑讯逼供的辩证分析，肯定其对于 遏制刑讯逼供现象的意义。 从我国立法、司法改革及世界建立沉默权制度的社会潮流三个方而论证分析 沉默权制度在我国现今国情下实行的可行性，并通过对刑事犯罪的迅猛增长的大 环境下讨论分析了对于沉默权制度的建立并非盲目效仿，而需进行理性选择。 沉默权制度对完善我国司法进程，平衡控诉双方权利力量有着不可替代的意 义。 关键词：沉默权制度；无罪推定；有罪推定;刑讯逼供;可行性 Abstract Silence from the concept based on the UKs old adage: anyone no obligation to sue, the defendants asked the suspect, the defendant in the prosecution process enjoyed by the investigators, prosecutors, the judiciary staff the right to remain silent.
