I I 摘 要 2011 年 5 月 1 日，《刑法修正案（八）》正式实施。我国刑法原来规定要构成盗 窃罪必须是盗窃数额较大或者多次盗窃（一年内盗窃三次以上）。《刑法修正案（八）》 将盗窃罪修订为：入户盗窃、携带凶器盗窃、扒窃，并且这三种盗窃行为入罪没有 数额的限制。自此，“入户盗窃”、“携带凶器盗窃”、“扒窃”被正式明文写入 刑法。笔者从新旧法律的对比以及司法实践中的问题，并参照国外相关立法和学者 观点，阐述了盗窃罪的入罪标准。本文正文分为四个部分： 第一章：盗窃罪入罪标准概述，概括了盗窃罪原有的定罪量刑标准；盗窃罪新 行为入罪的原因；盗窃罪修改后急待明确的标准； 第二章：入户盗窃的入罪标准，概括了入户盗窃中“户”的范围；入户的法律 性质问题；入户目的的非法性； 第三章：携带凶器盗窃的入罪标准，概括了携带凶器盗窃是否要求向被害人显 示、携带凶器盗窃的起算阶段、携带凶器是否要求为了盗窃、携带凶器盗窃与盗窃 数额的关系、怎样理解“凶器”的定义； 第四章：扒窃的入罪标准，概括了扒窃的成立要件、对扒窃不应一律入罪的原 因和相应的救济措施提出了建议。 关键词：刑法修正案（八）；入户盗窃；携带凶器盗窃；扒窃；入罪标准 II II Abstract May 1, 2011, the Criminal Law Amendment (h) formally implemented.Chinas criminal law already provided for to constitute a theft must be a large amount of theft or theft repeatedly (within one year of theft more than three times).
