万方数据 万方数据 摘要 摘 要 国际金融衍生交易的发展从开始到现在，已经越来越适应整个社会的发展。 如今，国际金融衍生交易在金融市场上占领一席之地，并有着无可取代的地位。 场外金融衍生品交易相对于场内交易，具有灵活、便捷等特征，受到了许多交易 主体的欢迎，其发展及规模均远远超过了场内衍生品交易。然而场外交易的风险 性使其发展的同时也伴随着越来越多的争议。在有关于国际金融衍生交易的许多 法律问题中，国际金融衍生交易的担保制度极为重要，是整个金融衍生交易的核 心。 与英美等发达国家相比较，我国金融衍生交易市场起步较晚，且市场相对并 不成熟。目前，我国没有一部专门的法律对国际金融衍生交易进行规范，这使得 我国场外金融衍生交易的发展困难重重。为了完善我国的场外金融衍生交易的担 保制度，本文将主要通过历史分析方法和比较分析方法，着重介绍国际金融衍生 交易担保制度的创设，并将英美德三国的场外交易的担保制度进行比较分析，从 而对场外金融衍生交易担保的相关法律问题进行较为全面的探讨，为构建和完善 我国的场外金融衍生交易的担保制度提出建议。 关键词：金融衍生交易、担保、信用支持安排 I Abstract ABSTRACT The International financial derivative trade is adapting the development of out society since the beginning to present. Nowadays, The International financial derivative trade won a place in the present financial market and occupied an irreplaceable status. Compared to floor trade, over-the-counter(OCT)derivatives trade featured with characteristics of convenience, expertness and quickness. OCT derivatives financial trade become popular among numerous trading subjects. Meanwhile, the development and scale of OCT derivatives trade far surpasses floor trading. However, the risk of OCT financial derivative trade has increasing been a source of controversy during its fasting growing scale. Associated with legal issues of the international financial trade, the utmost important credit guarantee system is the core of the financial derivative trade. Compared to that of such developed countries as Britain and US, the financial derivative trade system of our country is still much dropped behind, so does the immature domestic trade market.At present, there is no a specific law to regulate the international financial derivative trade, which has lead to a difficult condition of our marker. In order to improve credit guarantee system of our country’s OCT derivatives trade market, the following article is mainly applying historical analysis method and comparative analysis method to introduce the establishment of International financial derivative trade credit guarantee system.
