论新刑诉中技术侦查之问题 作者：萧凌 摘 要 我国新刑事诉讼法在“侦查”一章中增设了“第八节——技术侦查措施”，共有五个条文，其中，新规定了三类特殊的技术侦查措施——秘密监控、乔装侦查和控制下交付，具有重大且深刻的意义:一方面，我国刑事诉讼法首次对技术侦查措施给予了相关授权，在承认了技术侦查措施过程中收集的证据的合法性的同时，结束了技术侦查措施合理不合法的尴尬局面;另一方面，在刑侦案件中，侦查机关及其人员面对不得不使用技术侦查措施的现实必要性，以及适用过程中对公民的人格尊严权、住宅权、隐私权等基本权利具有威胁的现实危险性的两难局面，此次新刑诉修正案通过立法严格限制了技术侦查措施的适用，为控制犯罪而授权，为保障人权而控权，以授权的形式实现真正有效的控权，保证了控制犯罪和保障人权两大价值目标的平衡。但是，此次新刑诉修正案虽然从适用的主体、案件对象、执行期限、人权保障以及收集的材料是否能作为证据都做出了具体的规定，我们也不能忽视其中存在的相关不足。 关键词 新刑事诉讼法；技术侦查；技术侦查措施 Abstract Chinas new criminal procedure law in investigation is a chapter in the eighth sections -- technical investigation measures, a total of five articles, of which the new regulations, three kinds of special technical investigation measures -- secret surveillance, posing for investigation and controlled delivery, is of great and profound significance: on the one hand, the criminal procedure law of our country for the first time on the measures of technical investigation to the relevant authority, in recognition of the legitimacy of the evidence collection process measures of technical investigation of at the same time, the end of technical investigation measures reasonable illegimate embarrassing situation; on the other hand, in the criminal case, in the face of the investigation organ and its personnel necessary to use measures of technical investigation, the dilemma of real danger and the application process of the citizens right to human dignity, the right of residence, privacy and other basic rights has the threat, the new criminal procedure amendment to pass legislation to strictly limit the application of technical investigation measure, and authorized to control crime, for the protection of human rights.
