Sexual Orientation Discrimination DFEH Home性取向歧dfeh回家
Section 1 of Stats.1999, c. 592 (A.B.1001), provides: “SECTION 1. It is the intent of the Legislature that the purpose of this act is to incorporate in the California Fair Employment and Housing Act (Part 2.8 (commencing with Section 12900) of Division 3 of Title 2 of the Government Code) the prohibition against discrimination or different treatment in any aspect of employment or opportunity for employment based on sexual orientation, contained in Section 1102.1 of the Labor Code, as that section read on December 31, 1999. As was the intent of Section 1102.1 of the Labor Code, as that section read on December 31, 1999, this act is intended to codify the court decisions in Gay Law Students v. Pacific Telephone and Telegraph (1979) 24 Cal.3d 458 and Soroka v. Dayton Hudson Corp. (1991) 235 Cal.App.3d 654, prohibiting discrimination based on sexual orientation. Any conduct that would have been a violation of Section 1102.1 of the Labor Code, as it read on December 1, 1999, shall be deemed a violation of this act. Nothing in this section is intended to alter the definition of employer with regard to any bona fide scouting organization covered under Section 1102.1 of the Labor Code as it read on December 1, 1999.” * Defendant was an employer or other covered entity; Plaintiff was an employee of defendant/applied to defendant for a job/or other covered relationship to defendant; Defendant discharged/refused to hire/ or other adverse employment action against the plaintiff; Plaintiffs protected status of sexual orientation was a motivating reason for the discharge/refusal to hire/ or other adverse employment action; Plaintiff was harmed; and The discharge/refusal to hire/ or other adverse employment action was a substantial factor in causing plaintiff’s harm. On this record, the evidence presented by the DFEH to establish employment discrimination on the basis of sexual orientation is inconclusive.
