【摘要】 在我国的历史发展长河中,从来不缺乏各种形态的商业模式，而任何一种商业模式的出现都有其深刻的历史和现实根源。备受社会关注的流动商贩其实自古便有之，但是近几年来,随着经济结构的调整和城市化进程的加快,流动人口大量涌入城市,城市中流动商贩的数量迅速增加,给城市管理带来了诸多困难。一方面,他们采取流动式的经营方式维持生计,给市民带来了实惠和便利,同时缓解了社会的就业压力。另一方面,他们占道经营、乱扔垃圾,既堵塞交通又破坏市容,而且不纳税逃避检查,扰乱市场秩序,给城市带来了一定的负面影响,而城管与流动商贩就像是一对“冤家”,粗暴执法和暴力抗法事件在全国各地频频上演,流动商贩的问题已经成为城市治理的一大难题。面对愈来愈复杂的社会问题,政府已经变得力不从心、效率低下,流动商贩的治理不能达到预期效果,究其原因是传统的治理模式不能从根本上化解城管与流动商贩的矛盾,因此要建立多中心的治理模式,发挥社会组织的优势，最终实现政府与社会的合作共治。 2011年3月30日国务院第149次常务会议通过了《个体工商户条例》，自2011年11月1日起施行。其中无固定经营场所摊贩（流动商贩）可登记成为个体工商户的规定被很多媒体解读为“流动商贩合法化”。针对这一社会热点问题，我们以成都市双流县东升区为主要调研地点，以及其周边几所大学周围的流动商贩的经营现状作为研究切入点，综合借鉴前人的研究理论，剖析流动商贩的经营现状，在真实客观了解流动商贩经营现状的基础上，提出解决流动商贩问题的合理化建议，探求城市流动商贩的治理模式。 【关键词】 商业模式 流动商贩 流动商贩合法化 【abstract】existing commercial pattern has its deep historical and practicial source. The noticed ambulatory maketing rose in ancient time. While in the recent years,with the adjustment of commercial pattern and quick development of urbanization,the number of ambulatory population increased dramatically. At the same time it brought some problems in urban management.On the one hand,they had to live with ambulatory business which could bring convenience to citizens and release pressure of employment.On the other hand,they occupied streets,littered informally,blocked traffics,damaged the outlook of city,escaped from paying taxes which could disturb the order of marketing and bring certain negative effects.While the relationship between chengguan and ambulatory manager just like a pair of enemy,violent enforcement and resistance happen frequently in China.It has become a serious problem in the management of urban area.Faced with the more and more complex social problems,government felt hard and invalid, which can not reach expected achievement.The reason is that traditional administer pattern can not solve the contradiction between urban manger and ambulatory businessman.It is necessary to build a pattern which had a number of centres and took advantages of social organization so that b
