Ltd., hereinafter called the Seller, agrees to sell nickel at the following terms and conditions: 1. MATERIAL The material supplied shall be nickel in the form of Cathodes (the “Material”). 2. QUALITY The Material supplied shall be of Full Plate Cathodes LME quality, any brand in Sellers option. 3. ORIGIN Any origin in Sellers option. 4. QUANTITY The quantity of Material supplied shall be XXX (XXXXXXXXXXXX) MTS plus/minus a tolerance of 10(ten) percent. The scheduled month of delivery: April 2015 5. PRICE The price shall be any unknown London Metal Exchange Nickel quotation during the quotational period adjusted to June 17th,2015 plus a premium of USD XXX (USD XXXXXX) per MTS. 6. QUOTATIONAL PERIOD 6.1 The Buyer has the right to price on any London Metal Exchange working day or days from the Seller’s confirmation of receipt of fully workable letter of credit or pre-pricing cash deposit from the Buyer in an amount agreed by Seller until June 15th,2015. 6.2 Buyer shall declare pricing options under clause 6.1 in lot of minimum 30 (thirty) metric ton.
