梦，，户卜代 ky 首都师范大学 硕士学位论文 (同等学力) 论文分类号:B82一051 级:无 论德治与法治的互补性 学科、专业: 研究方向: 研究生姓名: 指导教师姓名: 指导教师职称: 2002年4月摘要 随着我国社会主义市场经济体系的建立，江泽民总书记关于德治与法治紧密 结合思想的重要性日益凸现。德治与法治，作为治理国家的基本手段，具有不同 的性质和功能。从理论和实践的层面深入研究二者的互补效应，对于提高治理国 家的水平，推进我国社会主义市场经济体系的完善，大有裨益。为此，本文将分 三部分探讨德治与法治的互补性。 第一部分从历史视角，考察德治与法治互补思想的演进。通过对中西方历史 发展中德治与法治互补理论的条陈，展现了德治与法治互补思想发展的脉络及其 社会实践效用。 第二部分从原理角度，剖析了德治与法治的互补机理。在梳理德治与法治的 内涵基础上，对道德与法律的价值内蕴、调整范围、规范要求、强制程度、约束 方式及干预形式的互补性进行了详尽的阐述，并得出德治与法治相结合，是国家 有效治理的客观使然。 第三部分从现实的层面，论证了德治与法治互补建构的必要性及其途径。基 于对市场经济法制性和道德性的分析，提出目前我国德治与法治的互补建构途 径:制度层面要做好道德法律化和制度伦理建设;思想层面要加强道德教化和法 律信仰的培养。 关键词:德治法治道德法律互补性Abstract ThemorecomPleteestablishmentofsocialistmarketeconomy system，themoreParamountthecloseeombinationoftheRuleofLaw withtheRuleofVirtueProPosedbyPresidentJiangzeming.AsPrimary modesofadministration，theRuleofLawandtheRuleofVirtuehas differentfeaturesandfunctions.Anin一dePthresearehintothe eomPlementationofthesetwomeasureswillbeofgreatvaluetoimProve theeffectivenessofleadershiPandthedeveloPmentofChinesesoeialist marketeconomysystem.Thisdissert卫tionexPloresthecomPlementation ofthetwomodesinthefollowingthreeParts.
