JIU JIANG UNIVERSITY 毕 业 论 文 题 目 检察官的自由裁量权研究 英文题目Study of the prosecutor’s discretion 院 系 政法学院 专 业 法学 姓 名 周亚楠 班级学号 A061131 指导教师 石浩旭 二零一零年六 摘 要 检察官拥有一定程度的自由裁量权对于实现个案公正、节约诉讼成本、提高诉讼效率以及实现程序公正都具有积极的意义，充分发挥检察官自由裁量权这一观点已渐成学界共识。通常认为在中国现行司法体制下，只有法官拥有自由裁量权，其独占性、专用性不可侵犯，法官在审判中的裁量权却能体现案件的个别化原则，体现司法公正、公平。但在检察机关履行公诉职能过程中，根据法律的规定，检察官的自由裁量权无时不显现出来，表现了检察官的独立司法属性。在现行中国检察、法院并列的司法体制状况下，检察官拥有自由裁量权是不可否认的。检察官的自由裁量十分广泛，尤其是在刑事诉讼中，检察官享有相当大的自由裁量权。但检察官并不是在所有领域都享有这种权利。同大多数权利一样，这种权利也不可避免地存在着被滥用的危险性，作为配置和制约司法权手段之一的刑事诉讼，在赋予检察官一定的自由裁量权的同时，必须建立相应的制约机制来防止其被滥用，我国检察机关应当进行相应的努力，以对其加以完善。 【关键词】检察官；自由裁量；权利；效益；公正 Abstract Prosecutors have a certain degree of discretion for individual justice, saving litigation costs and efficiency of the proceedings and the achievement of procedural justice has positive significance, give full play to the discretion of the Prosecutor has gradually become the academic consensus on this point.
