The task assigned for this comment is to consider whether a legal-cultural perspective can help to explain contrasts in national approaches to the legal problem addressed by the five studies presented in this issue - that is, the problem of how law should respond to employees objections, on grounds of conscience, to the carrying out of particular work tasks assigned by their employers, or particular ways of carrying them out. ... The choice of a very specific, closely defined legal problem area may suggest that it is only differences in the solutions provided by legislation and case law (not differences in the formulation of the problem) that could be considered in relation to differences in culture, including legal culture. ... By contrast, Professor Finkins and Professor Sanchezs papers, on the United States and Spain respectively, encompass a much wider range of possible contexts of resistance to objectionable work within employment relations. ... In Germany, it seems that public employment relations import state policy so that employees are more obliged to respect the ideas and orders of the state - which, Professor Wank notes, may sometimes be more restrictive of the employee than in the private realm. ... Few hints are given in Professor Hanamis paper as to why the Tokyo Board of Education in 2003 sought to enforce the hoisting of the national flag and the singing and playing of the national anthem, or why Japanese courts have adopted varying attitudes to teacher
