评2015年韩国国际私法中亲属关系与继承关系管辖权之立法修正案 冯霞摘 要：随着韩国2001年7月1日国际司法的全面修改，将“涉外私法”改称为“国际私法”，韩国在同法第二条中新制定了实际性关联原则的一般规定，作为国际审判管辖决定标准。从那时起，韩国的法院一直努力倾注于将同法第二条的抽象性标准变得具体化，经过15年后，通过立法制定关于实际性关联原则更具体的国际审判管辖规定。为此，韩国国际私法学会预定于2015年10月31日通过韩中国际私法学会联合专题研讨会，以韩国国际私法学会会员为主导而制定的联合专题研讨会用立法草案为基础，与中国国际私法学者们一起对韩国国际审判管辖的相关立法问题进行讨论。作为受邀中国学者，本文立足中国立法，结合国际条约以及相关国家立法例对2015年韩国国际私法立法案中关于家事案件，如婚姻、亲生子女、抚养、继承以及监护案件的国际审判管辖规定，从法条所涉及的基本理论、立法例、条文分析及修改意见等方面逐条进行了评议，但由于中国没有家事法庭以及家事管辖权的国内及涉外的规定，资料有限，再加上作者对韩国法律及立法背景的缺失，故本文意见仅供参考为宜。关键词：韩国国际私法立法案 亲属关系 继承关系 管辖权Abstract: With the overall amendment of South Korea’s international judicial system on July 1, 2001, its Private Law Concerning Foreign Affairs or Foreign Nationals was renamed Private International Law. The second article of its Private International Law established a new general rule of the actual contacttheory, which served as the criterion of its jurisdiction of the international trial. Since then, the courts of South Korea have been devoted to the specification of the abstract standard in the second article. After 15 years, South Korea now attempt to formulate specific provisions of its actual contact theory through legislation. To this end, a China- South Korea joint symposium on the legislation of South Korea’sjurisdiction of the international trial is going to be held on October 31, 2015 by South Korea Society of Private International Law. Based on a draft amendment drew by South Korea Society of PrivateInternational Law, scholars from the two countries are supposed to discuss the amendment in depth and give appropriate recommendations. The paper focuses on the articles relating to family matters jurisdiction in the draft amendment, such as the jurisdictions of marital matters, parent and child matters, maintenance, inheritance and guardianship. With the reference and comparison of the corresponding provisions in Chinese legislations, other countries’ legislations as well as international treaties, the paper discusses the articles from several aspects
