Prof. Ouyang Zhao Specialty：Journalism School of Journalism Communications of Chongqing University, Chongqing, China April 2013 重庆大学硕士学位论文  摘  要  中文摘要  2010 年，垫江 4 岁女孩小雅琳因被继母用插棍打成重伤，成为重庆媒体关注 的焦点。经过媒体不间断的报道，从当年 9 月 12 日事发至 11 月 19 日，短短 2 个 多月时间，小雅琳的继母翁光友就被一审定罪。这其中，“继母”这一身份无疑令 翁光友遭遇到了媒体推波助澜式的无限放大，媒体在有意无意间的偏向性引导， 令司法遭遇到了公众意见的影响。 我国一直在践行依法治国的理念，媒体审判的发生无疑是与这一理念相违背 的。从 2001 年开始，不少专家学者开始意识到媒体审判的问题，媒体审判也由此 逐渐被人们所熟知。法律自有一套严密的审判体系，当媒体干预进去之后，或多 或少都会影响到这一体系的正常运作。媒体进行舆论监督或热点事件报道是必要 的，但需要明确在报道的事前、事中，以及事后该如何正确的把握报道力度以避 免对正常的司法审判造成无法估计的影响。 本文通过案例分析为基本手段，从小雅琳事件入手，引入对比例证、沉默螺 旋理论、波特方块模型、以及笔者从事新闻业归纳总结的“无责任受访对象”现象， 就此剖析重庆媒体进行媒体审判的真相与实质，并探索解决办法。 关键词：媒体审判，小雅琳，案例分析 I 重庆大学硕士学位论文  英文摘要  ABSTRACT In 2010, a four year-old girl called XiaoYalin was badly injured by her stepmother with a stick, which attracted wide focus by the media of Chongqing . By reporting, from the time the incident occurred on September 12 to November 19, just over two months time, her stepmother Weng Guangyou was convicted of guity. In this case, the identity of stepmother” has undoubtedly been magnified. The medias intentionally or unintentionally biased guidance has influenced the trial of the court by the impact of public opinion. Our country has been practicing the concept of the rule of law, media trial is undoubtedly contrary to this philosophy. From 2001, many experts and scholars began to realize the question, the media trial has thus gradually been well known. Law has a set of strict justice system, when the media go after the intervention, more or less it will affect the normal operation of this system.
