我国西部农村土地问题的法学思考 摘 要 实施西部大开发战略，加快西部发展，逐步缩小各地区之间的发展差距，实现区域经济协调发展，最终达到各地区经济普遍繁荣和全体人民共同富裕，既是社会主义本质特征要求，亦是国民经济持续协调发展的内在需要。近年来，虽然西部大开发已经取得了举世瞩目的成就，Implementing the western development strategy,accelerate the development of west of china, gradually narrow the development gap between regions,to achieve coordinated development of regional economy, eventually reach the regions economic prosperity and common prosperity of all the people,these are both essential characteristic of socialism request and the coordinated development of national economy continued internal need. In recent years developing the western region has made remarkable achievements, but which exposed a number of issues, in particular the question of land. In this paper, the situation in the western rural land issues have been studied. First through field investigations and reading the relevant information, the following issues prevalent in the rural west have been found: destruction of cultivated land and land trimmer coming in serious condition, rural land transfers unreasonable, illegal occupation and approval of land are serious, the land requisition procedure unreasonable. Then through studying the universal issue of western rural land, especially focusing on rural villager’s cultural quality is not high and lack of legal awareness, rural land transfer system flawing, imperfect land law giving opportunity to land offence, economic interests driveing land offence recklessly breeding, the land requisition procedure was not being standardized,we analysis the reasons for the status quo of the west rural land issue. Finally, corresponding countermeasures has been proposed based on the outcome reasons after analysising. To let the west rural land issues have been an effective solution, we need to improve the rural land transfer system and the land requisition system. And land offence must be managed strengthen.
