辅修 法学 专业毕业论文 （2010春季班） 论文题目： 论我国无效婚姻赔偿制度的构建 原 学 院 宁夏大学新华学院 学生学号 12008248331 学生姓名 周楚蕙 指导教师 刘淑媛 摘 要 婚姻是人类社会亘古不变的话题，随着物质文明的发展，婚姻中存在的问题也越来越多，这些不论是对当事人双方还是子女，都有着严重的影响。我国《婚姻法》针对一些不断发现的问题，也相对地完善了法律，尤其是在2001年，我国《婚姻法》建立了比较完整的无效婚姻制度,填补了婚姻立法的空白。但是，其中有一些重要的内容在法律法规中没有相应的规定，如我国无效婚姻制度中赔偿制度的不完善，导致受害人的合法权益无法得到应有的保障，从而引起当事人之间的财产纠纷，如果想要预防并且解决此类违法行为的发生，就必须完善无效婚姻的赔偿制度。 本论文总共分为五个部分：第一个部分引言主要是交代了论文的立意所在；第二部分主要写的是我国婚姻法的立法现状，从而引出问题；第三部分是分析解决问题的必要性和可行性；第四部分是核心部分，主要写的是无效婚姻赔偿制度的构建,其中从无效婚姻赔偿责任的构成要件、赔偿范围和赔偿责任的适用几方面来具体说明；第五部分是总结，就前面几个部分进行总括性的概述。 关键词：无效婚姻；财产；赔偿；制度完善 Abstract The marriage is the human society through ancient times invariable topic, along with the material civilization development, the question which in the marriage exists more and more are also many, no matter these are to litigant both sides or the child, all has the serious influence.Our country Marriage law the question which discovered unceasingly in view of some, also has consummated the law relatively, in 2001, our country Marriage law has in particular established the quite complete invalid marriage system, has filled the marital legislation blank.But, including some important contents not to have the corresponding stipulation in the legal laws and regulations, if in our country invalid marriage system compensates the system not to be imperfect, causes the safeguard which victims legitimate rights and interests are unable to obtain should have, thus causes between litigants property dispute, if the wish prevents and solves this kind of illegal activity occurrence, must consummate invalid marital the compensation system.
